If, at some point in your life, you are no longer capable of handling your own affairs, you may need someone to make important decisions on your behalf.
A Lasting Power of Attorney (LPA) is an important legal document that enables a person who has capacity and is over 18 (Donor) to choose another person or people (Attorney(s)) to make decisions on their behalf.
There are 2 different types of LPA’s: • A Property and Financial affairs LPA allows you to choose someone you trust to make decisions about your finances, such as selling a house or managing a bank account. Your Attorney can use your LPA as soon as it is registered unless you have placed a restriction on it. • A Health and Welfare LPA allows you to choose someone you trust to make decisions about health and personal welfare, for example where to live, day-to-day care or medical treatment.
These decisions can only be taken on your behalf after the LPA has been registered and you no longer have the capacity to make to make the necessary decisions yourself.
Having a LPA document drawn up is the first step toward protecting your estate should you become incapacitated or incapable of making financial and business decisions for yourself. An Attorney is appointed to make decisions as if they were the Donor themselves and must always in the best interests of the Donor.
How can we help? The process involves the identification of key people, which we can do with you in discussion. There are important decisions to be made about whether Attorneys are to act jointly or jointly and independently and what approach is to be used in relation to medical decisions. Once we’ve obtained these preliminary instructions we can then begin the process by drafting sets of forms for your consideration.
